OVERVIEW Welcome to Sinéad Guilfoyle Art. Throughout the site, the terms “we”, “us” and “our” refer to Sinéad Guilfoyle Art. Sinéad Guilfoyle Art operates this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

 

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

 

SECTION 1 - ELIGIBILITY AND ACCOUNT By agreeing to these Terms, you represent that you are at least the age of majority in your country or province of residence. You are responsible for maintaining the confidentiality of your account and password. We reserve the right to refuse service to anyone for any reason at any time.

SECTION 2 - ARTISTIC REPRESENTATION AND HANDMADE CHARACTER We make every effort to display as accurately as possible the colours and images of our products. However, we cannot guarantee that your computer monitor's display of any colour will be accurate. Abstract Artwork Clause: Due to the organic nature of abstract techniques, textures, and the interplay of pigments, minor variations in surface texture, "character marks," or "drips" are inherent to the original work and do not constitute defects. By purchasing, you acknowledge that you are acquiring a unique, handmade piece of fine art.

SECTION 3 - ORDERS AND CUSTOM COMMISSIONS All orders are subject to acceptance and availability.

  • Offer to Purchase: Your order is an offer to buy; our acceptance occurs only when we charge your card and dispatch the goods.
  • Manual Acceptance Clause: "A binding contract is only formed when we send a secondary, manual email explicitly stating that your order has been 'Accepted' or when the Goods are dispatched. The automated 'Order Confirmation' is an acknowledgment of receipt only." 
  • Bespoke/Commissioned Works: In accordance with EU Consumer Protection (Distance Selling) regulations, the "Right of Withdrawal" or 14-day cooling-off period does not apply to goods made to the consumer’s specifications or clearly personalised. This includes all commissioned paintings and bespoke original works. These items are non-refundable once the commission agreement has been signed and production has commenced.

SECTION 4 - PRICES AND BILLING Prices for our products are subject to change without notice.

  • International Orders: For customers outside of Ireland or the EU, please note that your order may be subject to import duties, taxes, and customs processing fees. These are the sole responsibility of the buyer.
  • Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
  • Sinéad Guilfoyle Art is not currently registered for VAT under Irish VAT threshold guidelines; therefore, VAT is not included in the purchase price, and a VAT breakdown cannot be provided on invoices

SECTION 5 - SHIPPING, TITLE, AND RISK Delivery dates are estimates and not guaranteed.

  • Title of Goods: For high-value original works, while risk of loss passes to the carrier upon our delivery of the item, Sinéad Guilfoyle Art will facilitate insurance claims on the collector’s behalf in the event of transit damage, provided we are notified within 48 hours of delivery.
  • White-Glove Service: Certain high-ticket items may require specialised art handling. We will contact you directly if additional shipping arrangements are necessary.

SECTION 6 - INTELLECTUAL PROPERTY AND REPRODUCTION RIGHTS The Services and all materials therein, including images, text, and graphics, are the exclusive property of SineadGuilfoyleArt.

  • Copyright Retention: The sale of an original artwork or print does not transfer copyright or reproduction rights to the buyer. Sinéad Guilfoyle Art retains all rights to reproduce the work, including for the purpose of prints, digital assets, or licensing, unless a separate written transfer of copyright is signed by both parties.
  • Personal Use: Your purchase grants you a license to display the work for personal, non-commercial use only. You may not reproduce, modify, or exploit the artwork for commercial gain.

SECTION 7 - THIRD-PARTY TOOLS AND LINKS We may provide you with access to third-party tools (such as "View in Room" AR features) which we neither monitor nor have any control over. Use of these tools is at your own risk.

 

SECTION 8 - PERSONAL INFORMATION Your submission of personal information through the store is governed by our Privacy Policy. Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

 

SECTION 9 - ERRORS AND INACCURACIES Occasionally there may be information on our site that contains typographical errors or omissions related to product descriptions or pricing. We reserve the right to correct any errors and to cancel orders if any information is inaccurate at any time without prior notice.

 

SECTION 10 - PROHIBITED USES You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others.

 

SECTION 11 - LIMITATION OF LIABILITY To the maximum extent permitted by Irish law, Sinéad Guilfoyle Art shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service or any products procured using the service. Our total liability to you for any claim shall not exceed the amount paid by you for the product.

 

SECTION 12 - INDEMNIFICATION You agree to indemnify and hold harmless SineadGuilfoyleArt from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms of Service.

 

SECTION 13 - SEVERABILITY In the event that any provision of these Terms of Service is determined to be unlawful or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.

 

SECTION 14 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Ireland. You and Sinéad Guilfoyle Art consent to the exclusive jurisdiction of the Irish Courts.

 

SECTION 15 - CHANGES TO TERMS OF SERVICE We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check our website periodically for changes.
