Art Sales Terms

Understand your rights and responsibilities when purchasing art from our online platform in Ireland.

1. Definitions

“we”/“us”/“our” means Sinéad Guilfoyle, trading as Sinéad Guilfoyle Art, sole trader, with business address at Ahilbeg, Kealkill, Cork, Ireland.
“you”/“customer” means any person purchasing goods via our website https://sineadguilfoyleart.ie.
“Goods” means any original artworks, prints, or other art products offered for sale.

2. Scope & Acceptance

By placing an order through our site, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions.

3. Contract Formation

Order: When you click “Buy” and complete checkout, you submit an offer to purchase the Goods.
Acceptance: We accept your order when we send you an Order Confirmation email. At that point, a binding contract comes into existence.

4. Pricing & Payment

All prices are shown in Euro (€) and include Irish VAT where applicable.
We reserve the right to correct pricing errors.
Payment must be made in full at checkout via the methods listed (e.g. credit/debit card, PayPal).
If payment cannot be authorised, we may cancel your order.

5. Delivery & Shipping

Domestic (Ireland): Flat rate €50 per order. Orders ship within 3–5 business days and include tracking with signature on delivery.
International: We ship worldwide. Please contact us at studio@sineadguilfoyleart.ie for a personalised shipping quote, including carrier options, transit times, and applicable duties or taxes.

6. Right of Cancellation (EU Distance Selling)

Under the EU Consumer Rights Directive and Ireland’s Distance Selling Regulations, you may cancel your purchase within 14 calendar days from the day after receipt of the Goods. To return a non-custom item:

Notify us in writing before the 14-day period ends.
Return the Goods within 14 days of notification, in original condition and packaging.
You bear the direct cost of return shipping; we will refund the purchase price (excluding outbound shipping) within 14 days of receipt.

Exceptions: Custom, made-to-order, or personalised artworks are exempt once production has begun with your express consent.

7. Returns & Refunds

Non-custom returns: Refund via original payment method after inspection.
Damaged/Defective goods: Contact us within 7 days of delivery with photos; we will cover return shipping and provide a repair, replacement, or full refund.

8. Intellectual Property

All images, text, designs, and content on this website are the property of Sinéad Guilfoyle or licensed to her.
You may view and download material for private, non-commercial use only. Any other use (reproduction, modification, distribution) is strictly prohibited without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, Sinéad Guilfoyle Art shall not be liable for any indirect, incidental, or consequential loss arising from your purchase or use of the Goods.
Our total liability for direct losses shall not exceed the purchase price paid for the specific Goods giving rise to the claim.

10. Privacy & Data Protection

We collect and process your personal data in accordance with our Privacy Policy.
We will not share your information with third parties except as necessary for order fulfilment (e.g. shipping carriers) or as required by law.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Ireland, and you submit to the exclusive jurisdiction of the Irish courts.

12. General

We reserve the right to update these Terms at any time. Changes take effect as soon as they are posted on our website.
If any provision is held invalid, the remainder shall continue in full force and effect.
